Justin K. Victor is a trial lawyer who has assisted clients in recovering over $100 million in complex civil litigation. Mr. Victor has also secured temporary restraining orders, preliminary injunctions and permanent injunctions in state and federal court for clients seeking to protect against the misappropriation of trade secrets and to enforce restrictive covenants.

Mr. Victor has successfully defended clients facing claims totaling over $300 million. For example, Mr. Victor defends employers in class and collective actions arising under the FLSA and related state wage and hour laws. Mr. Victor also defends executives and board members in derivative and direct actions arising under state and federal law.

In addition to an active litigation practice, Mr. Victor counsels employers of all sizes in the design and implementation of employment policies, practices, proactive audits, and workplace training.

  • Represented non-profit in breach of contract dispute with vendor. Secured $2.6 million settlement on behalf of client.
  • Represented former founder and Chief Executive Offer in recovering over $17 million in dispute concerning client’s equity.
  • Represented government contractor where a competitor claimed $4.73 billion in damages and sought injunctive relief that would restrict client from bidding on future contracts associated with the Army’s Blackhawk UH-60V helicopters. Following the filing of a motion to dismiss, secured a “walk-away” non-monetary settlement for the client without any agreement to the broad injunctive relief requested within the Complaint.
  • Represented Senior Executive facing allegations that the client misappropriated a prior employer's trade secrets and confidential information. Secured a “walk-away” non-monetary settlement.
  • Represented scholastic e-sports non-profit in a breach of contract matter against a former business partner. Achieved a six-figure monetary settlement paid to the client at mediation. 
  • Represented health care businesses concerning alleged breaches of an asset purchase agreement. Secured temporary restraining order, preliminary injunction, permanent injunction, and monetary damages.
  • Represented power equipment service provider in securing a pre-litigation settlement and injunctive relief.
  • Represented benefits provider in securing a pre-litigation settlement and injunctive relief.
  • Represented utilities service provider in securing injunctive relief.
  • Represented clinical research services and technology provider in trade secrets matter involving allegations that client’s confidential and trade secrets information was stolen and misappropriated by a competitor. Secured permanent injunction and monetary damages.
  • Served as trial counsel for two-week bench trial in the Delaware Court of Chancery. Represented former Chief Executive Officer, President, General Counsel, Chief Financial Officer, and board members. All causes of action against represented parties dismissed.
  • Represented international travel company in a trade secrets matter involving allegations that client’s confidential and trade secrets were stolen and misappropriated by a competitor. Secured permanent injunction and monetary damages.
  • Represented national IT solutions provider in breach of contract and trade secrets matter. Secured preliminary injunction and permanent injunction.
  • Represented global investment bank and financial services provider in multiple nationwide collective actions alleging FLSA violations. Plaintiffs sought alleged unpaid wages, including overtime, incurred for time spent working off-the-clock and for misclassification. Defeated plaintiffs’ motions for conditional certification in both the Southern District of New York and the Middle District of Florida.°
  • Represented international technology services provider in lawsuit brought by a competitor alleging tortious interference with contractual relations. Achieved complete dismissal through a motion for summary judgment and affirming opinion by the Third Circuit Court of Appeals. °
  • Represented international fitness brand in numerous trade secrets matters. Secured settlements and agreements to injunctive relief prior to litigation.
  • Represented multiple international retailers in single-plaintiff matters alleging wrongful termination and allegations of discrimination. Conducted numerous internal investigations. Prepared or counseled employers on the preparation of investigation reports, and counseled on both specific and systemic measures to minimize the risk of liability.
  • Worked closely with employers to design and implement improved, preventive human resources systems, including development of new employee-facing policies and HR/supervisor manuals, development and redevelopment of job descriptions, performance review systems, and disciplinary procedures and training of managers on all of the above.
  • Developed COVID-19 workplace policies and procedures for multiple employers.
