Albert K. Heng is a patent and trademark attorney representing clients across the United States, Europe, and the Middle East, ranging from individual inventors to startups, international corporations, venture capital firms, seed fund/incubators, and Fortune 500 companies, primarily in the medical device and digital health industries. He handles matters involving medical technologies including co-manipulation surgical systems, teleoperated robotic surgical systems, neurostimulation systems, imaging systems including those utilizing artificial intelligence and machine learning, implantable medical devices, ablation devices, medicine dispensers, and microfluidics devices, as well as technologies including aerospace structures, firearms, machinery, protective gear, autonomous vehicles, HVAC and boiler systems, waste management processes, and filtration systems.

Albert manages his clients’ global IP portfolios spanning across the United States, Europe, Asia, South America, and Oceania. He performs prior art searches, prepares and prosecutes domestic and international utility and design patent applications, and conducts invalidity, patentability, freedom-to-operate, and scope-of-coverage analyses for complex due diligences. He also provides litigation support, prepares cease and desist letters, and handles trademark searching and prosecution. Albert has experience with the USPTO’s Prioritized (Track 1) Patent Examination Program, Patent Prosecution Highway, After-Final Consideration Program 2.0, Pre-Appeal Brief Conference Pilot Program, appeals before the Patent Trial and Appeal Board, and Reissue applications. 

As a member of the LGBTQ+ community and the son of Cambodian refugees, Albert is dedicated to pro bono work, particularly assisting LGBTQ+ asylum seekers in preparing and filing affirmative and defensive asylum applications, and has successfully obtained Temporary Protected Status for a Ukrainian-born client. He is actively involved with the Tom Homann (LGBTQ+) Law Association where he served on the board of directors for three years, as well as with the Pan Asian Lawyers of San Diego and the San Diego Intellectual Property Law Association.
