Amanda L. Carney concentrates her practice in the areas of Commercial Litigation and Labor & Employment law, where she defends public and private employers, as well as individuals, in a broad range of matters.

Amanda has diverse experience handling employment cases involving discrimination, harassment, retaliation, wrongful termination, and numerous other personnel and workplace issues arising in state and federal courts and before state and federal agencies. Amanda regularly provides counselling to clients on employment-related compliance issues pertaining to wage and hour laws, harassment, discrimination, reasonable accommodations, restrictive covenant agreements, hiring practices, internal investigations, and employee handbooks/policies. She advises companies of all sizes, including start-ups, on the various employer obligations under state and federal laws.

Amanda is also experienced in performing employment due diligence in connection with mergers and acquisitions. In addition, her litigation practice covers a variety of business torts, including contract disputes, fraud, misrepresentation, misappropriation of confidential and proprietary information, and claims arising under the Massachusetts Tort Claims Act.

Amanda is passionate about providing legal services to low-income individuals in the Greater Boston area. She has spent hundreds of hours providing pro bono legal services through her involvement with a national organization advocating for children in immigration proceedings. She also served as the firm’s fundraising co-captain for the Greater Boston Legal Services Associates Fund Drive, and has helped raise thousands of dollars to support GBLS’s work on behalf of domestic violence survivors.

  • Represented Marque Brands, LLC, an affiliate of Neuberger Berman, in connection with its acquisition of a majority ownership in America’s Test Kitchen (“ATK”) and its associated brands, including Cook’s Illustrated and Cook’s Country. ATK is a food and culinary media business, which leverages its industry-leading testing process for recipes and kitchen equipment to produce top class recipes and unbiased product reviews. ATK and its diverse portfolio of brands has an expansive audience across various media platforms.
  • On behalf of various public and private employers, obtained findings for lack of probable cause before the Massachusetts Commission Against Discrimination (MCAD) and dismissals before the Equal Employment Opportunity Commission (EEOC).
  • Conducted internal investigations involving claims of discrimination and harassment.
  • Represented employers in injunctive proceedings regarding the enforcement of non-competition and non-solicitation agreements, theft of company property and misappropriation of confidential and proprietary information.
  • Assisted state agency with gathering, reviewing and producing documents, and interviewing witnesses, in connection with responding to inquiry by state legislative committee.
  • Represented employers in putative class actions alleging independent contractor misclassification and violation of wage and hour laws.
  • Achieved summary judgment ruling in U.S. District Court in Massachusetts on all claims concerning discrimination and failure to accommodate.
  • Achieved dismissal of claims barred by the Massachusetts Tort Claims Act.
  • Member of team assisting company with employment issues stemming from large-scale reduction-in-force.
  • Conducted due diligence on employment matters in connection with mergers and acquisitions.
  • Drafted numerous policies, notices and employee handbooks compliant with federal, state and local laws for single and multi-state employers.
  • Prepared documents related to employment including: offer letter, employment agreement, separation agreement, non-competition agreement, non-solicitation agreement, confidentiality agreement, proprietary information and inventions agreement.
