Daniel I.A. Smulian

Daniel I.A. Smulian is a shareholder in the firm's Litigation Practice. He is also a member of the firm's Pharmaceutical, Medical Device & Health Care Litigation Group and Appeals & Legal Issues Group. He focuses on defending medical device and pharmaceutical companies in all phases of products liability litigation. He also represents clients in complex commercial cases, including trade secrets disputes and consumer class actions. Dan has experience in all phases of litigation, including briefing, depositions, expert discovery, trials, and appeals.

Dan also has significant appellate experience in a wide variety of contexts. He has, for example, been responsible for successfully defending dismissals on motions, e.g., Naquin v. Medtronic, Inc., 2021 U.S. App. LEXIS 31121 (5th Cir. Oct. 18, 2021), and jury verdicts in his client’s favor. E.g. Hurley v. HeartPhysicians, P.C., 3 A.3d 892 (Conn. 2010). He also has prevailed in appeals from adverse verdicts, including the reversal of a $30 million dollar award against his client. In all of these, and other, instances, Dan has been instrumental preserving issues for appeal during trial, and selecting issues and arguments in the subsequent appeal.
