Ally Lizano counsels clients across the supply chain on the laws applicable to consumer products. In particular, Ally focuses her practice on compliance, enforcement, and litigation of California’s Proposition 65. Ally defends clients in various industries including food and beverage, cosmetics and personal care, apparel, and general consumer goods in actions relating to Proposition 65 chemicals of concern such as heavy metals, phthalates, and per- and polyfluoroalkyl substances (PFAS). Ally also regularly advises clients on Proposition 65 compliance and risk mitigation. 

Additionally, Ally defends consumer product companies against allegations of deceptive or misleading advertising claims, including actions involving California’s Consumers Legal Remedies Act (CLRA) and Unfair Competition Law (UCL).

Ally also has experience with environmental enforcement defense. She has experience litigating complex, multi-party Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and contaminated property cases. She represents clients dealing with enforcement matters with various state and federal agencies. This includes matters involving the U.S. Environmental Protection Agency (EPA), the State Water Resources Control Board (SWRCB) and its Regional Water Quality Control Boards, and the Department of Toxic Substances Control (DTSC). She advises clients in environmental due diligence and compliance with environmental laws such as the Resource Conservation and Recovery Act (RCRA), the Clean Air Act (CAA) Risk Management Program, and the state counterpart laws and regulations.

  • Reviewed land use covenants entered between clients and Regional Water Boards, Department of Toxic Substances Control, and municipalities to counsel clients regarding scope of permissible property uses.°
  • Assisted client in obtaining a variance from a Regional Water Board land use covenant.°
  • Facilitated negotiations for Proposition 65 settlements for consumer products (including food products) for various clients.°
  • Researched and assisted developing regional grocer Standard Operating Procedure for transportation of hazardous waste to comply with RCRA and California Department of Toxic Substances Control regulations.°
  • Counseled grocer and retailer clients on compliance with California’s Beverage Container Recycling and Litter Reduction Act.°
