Jay Guiliano has more than 25 years of experience challenging patents and has decades of experience with invalidity analysis. He concentrates his practice on patent litigation and post-grant proceedings including inter partes reviews and ex parte reexaminations across a variety of technologies, including cellular telephones, medical devices, electronic payment systems, aeronautical oxygen systems, fuel injection control systems, player tracking for gaming systems, interactive voice response systems, parking brake systems, and tire pressure monitoring systems.

Jay’s telecommunications experience includes all phases of litigation and settlement for automated call processing systems and mobile telephone activation systems. He has served as the lead invalidity defense attorney for joint defense group coordinating defenses against 90+ patent claims. His experience also includes a section 103 common defense summary judgment order, serving as a Discovery Coordination Committee member, and lead license negotiator for consortium and individual companies during MDL litigation.

Jay’s control systems experience includes leading fact and expert depositions and court hearings related to patent portfolios for vehicular fuel injection control systems and on-board oxygen generating systems for military aircraft. He has coordinated joint defense group strategy, expert discovery and reports, as well as claim construction proceedings for brake control and tire pressure monitoring system litigations, managed expert report and depositions, concluding in summary judgment motions involving tire pressure monitoring systems.

Jay continues to conduct patent prosecution for constellation management and flight control systems involving LEO satellites, along with patent litigation and post-grant challenges for mobile device applications, and other counseling involving content management, vendor, supplier, employment, and partner agreements, all involving space and satellite technology companies.

Jay has considerable advocacy experience, having been involved in more than 50 post-grant proceedings and having represented clients in multidistrict patent litigation.
