Valery Dayne García Zavala focuses her practice on antitrust matters, representing clients in mergers and investigations for possible absolute and relative monopolistic practices, as well as in preventive consulting to help companies avoid antitrust law violations.
In addition, she has represented clients from different sectors in administrative and litigation proceedings before the Mexican antitrust authorities: the Federal Antitrust Commission (COFECE) and the Federal Telecommunications Institute (IFT).
Valery has broad experience representing clients in administrative amparo proceedings, defending their interests before federal courts for antitrust, broadcasting, and telecommunications.

- Representation of the Mexico City Airport in the investigation conducted by the Federal Economic Competition Commission under its new power to investigate and regulate essential facilities and/or “barriers to competition.”
- Representation of an important maritime passenger transportation group before COFECE in an investigation of alleged absolute monopolistic practices (cartel) in the maritime transportation market. COFECE imposed a sanction on the economic agents; however, in specialized courts, COFECE’s resolution was declared null and void by obtaining a simple injunction in favor of the client’s interests.
- Representation of economic agents in the procedure initiated by COFECE for the alleged commission of absolute monopolistic practices in the market for the distribution of liquefied petroleum gas at the national level.
- Representation of an economic agent in a procedure initiated by COFECE for the alleged commission of absolute monopolistic practices in the market of intermediation of debt securities issued by the Mexican government.
- Advised Colegios de Corredores Públicos (CCP) and Mexico City International Airport in investigations initiated by COFECE regarding alleged relative monopolistic practices or abuse of dominance.
- Advising one of the main financial groups in an investigation for relative monopolistic practices (abuse of dominance) in the credit information market. COFECE’s Investigating Authority accused this group of discriminatory treatment; however, the Plenary of COFECE found no such violation of the law.
- Representation of private equity funds in merger notification proceedings and their respective authorization by COFECE in the acquisition of several infrastructure projects, including highways, telecommunications assets, and social infrastructure, through funds listed in the Mexican Stock Exchange.
- Represented Grupo Lauman/El Financiero on antitrust/competition clearance to participate in the first open to air TV license tender in Mexico’s history.°
- Advised a company in the broadcasting sector on its participation in the procedure carried out by the Federal Telecommunications Institute to declare a broadcasting company as “preponderant.”
- Represented the Association of Steel Producers, the Association of the Automotive Industry, pharmaceutical companies, companies in the transportation industry, construction products, among others, in the implementation of policies for compliance with the Competition Law.°
- Legal advice in connection with measures issued by COFECE derived from the COVID-19 pandemic, to avoid absolute monopolistic practices in the non-residential real estate leasing market.
- Representation of economic agents in a procedure initiated by COFECE to determine if there are effective competition conditions in the market for the distribution of liquefied petroleum gas at a national level, as well as in the establishment of maximum prices for liquefied petroleum gas by the Energy Regulatory Commission (Comisión Reguladora de Energía).
- Representation of an economic agent in a procedure initiated by COFECE to determine if there are effective competition conditions in the maritime passenger transportation service market in routes with origin and/or destination in the northern zone of the state of Quintana Roo.
