Silver, shareholder in global law firm Greenberg Traurig, LLP’s International Arbitration & Litigation Practice, participated in Juris Conferences LLC’s Thirteenth Annual Investment Treaty Arbitration Conference held April 8 at the Washington Plaza Hotel in Washington, D.C. Juris Conferences hosts various conferences and symposiums to promote discourse between figures in International Arbitration and Dispute Resolution.
Silver participated in the panel discussion, “Should Costs Go with the Cause in Investment Treaty Arbitration?” The session focused on investment treaty arbitration, which from its inception has been a unique, hybrid form of international dispute settlement. With so much of its practice, and most of its practitioners, borrowing from international commercial arbitration, it might have been expected that costs would increasingly be awarded with the cause too. Panelists discussed the argument that investment treaty arbitration is better understood as a form of international administrative law, for which a strict rule of costs following the cause might discourage access to justice.
Silver focuses her practice on international litigation and dispute resolution. She advises Sovereign States and private clients in international arbitration proceedings, including arbitrations before the International Centre for Settlement of Investment Disputes and the Permanent Court of Arbitration under the United Nations Commission on International Trade Law Arbitration Rules, in a wide array of sectors, including energy, infrastructure, telecommunications, and the environment.
