Edgar Olvera Jiménez focuses his practice in the telecommunications sector, consumer protection, antitrust and competition, and administrative law, with over 25 years of experience working on infrastructure and public and private projects, regulations, public policies, among others.

Since he joined the firm, he has advised national and international companies and federal and local governments in the technology, telecommunications, media, broadcasting, e-commerce and hospitality, retail, and gaming industries, among others.

Edgar led multidisciplinary teams and highly complex projects in his previous positions at Mexico’s Ministry of Communications and Transportation and Consumer Protection Agency (PROFECO).

In his previous role as Undersecretary of Communications for Mexico’s Ministry of Communication and Transportation (MCT), Edgar participated in the design and implementation of the country’s recent telecommunications reforms. He spearheaded the United States-Mexico-Canada Agreement (USMCA) negotiations in this sector and fostered infrastructure investments by promoting infrastructure projects from the federal government (rights of ways, poles, and federal buildings).

As Coordinator of Technical and Regulatory Projects for the MCT, Edgar also participated in landmark projects, including the acquisition of the Mexican Satellite System (MEXSAT) and the bidding of the dark fiber of the Federal Electricity Commission (CFE). Additionally, he was involved in the largest public-private partnership (PPP) project in Mexican history, known as “Red Compartida,” a wholesale 4G shared network in Mexico.

Experience

  • Ministry of Communications and Transportation (MCT)
    • As Undersecretary of Communications of the MCT, Edgar designed, proposed, and executed policies and programs for telecommunications and broadcasting for the Mexican federal government.°
    • Participated in the conceptualization and negotiation of the Constitutional Reform of the Telecommunications, Broadcasting and Antitrust Law, working closely with the Congress. This has been recognized as a major beneficial reform for users in Mexico.°
    • Conceptualized and negotiated the new Federal Law of Telecommunications and Broadcasting and ensured its implementation.°
    • Led and participated in the negotiations of various international treaties, such as the United States-Mexico-Canada Agreement (USMCA), the Trans-Pacific Partnership (TPP and TPP11), and the Pacific Alliance (chapters telecommunications, broadcasting, trade electronic and state companies).°
    • Served as the Mexican representative before the International Telecommunication Union (ITU), the Organization for Economic Co-operation and Development (OECD), the World Trade Organization (WTO), and the Inter-American Telecommunication Commission (CITEL), to attend evaluations, committees, studies, and projects, between 2009 and 2018.°
    • Led the team in charge of conceptualizing and executing landmark telecommunications projects in Mexico, such as public-private partnerships (PPPs) of Red Compartida and Red Troncal, CFE dark fiber tender, and acquisition of the MEXSAT satellite system.°
    • Promoted policies and programs to release infrastructure projects within the telecommunications market, including poles, federal buildings, and rights of way of the federal government, and implemented deregulation policies to encourage and facilitate infrastructure investments.°
    • Oversaw the legal advice and defense within the MCT of tenders 20 and 21, the modification of the title of Telmex, Red Compartida, Interconnection rates, and arbitrations: Telefónica vs México (APRI MEX-ESP), Clearwire and MVS vs Mexico (NAFTA), and Eutelsat vs. Mexico (APRI MEX-FRA).°
    • Designed and implemented the first policy of extensions for concessions in telecommunications and radio broadcasting, including a sanctioning policy. Under Edgar’s charge, sanctions were applied to concessionaires under a new procedure, strengthening the government’s position and generating trust in the sector.°
    • Responsible for the study and authorization of corporate movements, mergers, splits, transfers of shares, and assignments of rights related to telecommunications concessionaires.°
  • Consumer Protection Agency (PROFECO)
    • As Deputy Director General, Edgar was responsible for coordinating the general directorates of the Deputy Attorney General for Services and providing advice and legal defense in consumer protection matters.°
    • Collaborated on reforming the Consumer Protection Federal Law in real estate matters, arbitration, sanctions, intermediate consumption, and compensation mechanisms.°
    • Served as Mexico’s representative before the OECD on consumer protection issues in 2007.°
    • As Director of Conciliation, Edgar established the policies, rules, and procedures for conciliation processes and the implementation of a CRM system throughout the country.°
