Joseph F. Coniglio is the Managing Shareholder of the firm's Dallas office. He has wide-ranging experience in the areas of health care law and complex business litigation. He utilizes his 20-plus years of experience in the health care industry to assist a wide variety of health care related entities and providers including hospitals, physician groups, long term care facilities, as well as clinical labs and pharmacies in litigation and transactional matters. He also provides service on a national basis to privately held portfolio companies as well as publicly traded companies related to corporate entity issues, operational disputes, and health care regulatory matters. Joe advises health care clients on liability exposure related to federal and state health care regulatory compliance involving complex fraud issues and health care reimbursement disputes, as well as professional liability and risk management. He also represents health care providers before their respective state boards in grievance and disciplinary proceedings.

  • Representation of national clinical lab including comprehensive multi-state review of clinical lab statutory compliance regulations for billing and licensure structure as well as related legal advice concerning business operations.
  • Multimillion-dollar jury verdict in favor of pharmacy client in Dallas County trial after client was initially sued for breach of contract and breach of fiduciary duty, among other allegations. 
  • Representation of Psychiatric Hospital related to issues surrounding challenge to proceed with Medicare Termination prior to Administrative Hearing.
  • Representation of Hospital System in Arbitration against Physician Staffing Company related to issues of breach of contract and non-compete requirements.
  • Preparation of risk management and liability exposure analysis for Healthcare Management Company related to compliance issues as well as liability exposure for contractually related corporate entities.
  • Representation and counseling as National Counsel for Physician Management Corporation regarding allegations against corporate entities based on claims of employment, actual agency, single business enterprise, and joint venture with other entities and health care providers.
  • Representation of nonprofit assisted living facility related to voluntary refund and self-disclosure of Medicare claims.
  • Representation of nonprofit hospice entity related to entity formation and corporate compliance issues.
  • Representation of hospital in connection with peer review proceedings as well as quality assurance initiatives.
  • Representation of national hospital group purchasing organization in connection with health care regulatory issues related to various service and supply agreements.
  • Representation of Plastic Surgery Physician Group and National Healthcare Management Company related to preparation of physician agreements, patient consent and disclosure statements, management service agreements, and compliance issues.°
  • Representation of Anesthesiology Group in negotiation of contractual arrangement and preparation of services agreement with hospital corporation and affiliated companies.
  • Summary judgment on behalf of Physician Staffing Corporation regarding direct negligence and vicarious liability allegations based on claims of employment, actual agency, single business enterprise, and joint venture with other entities and health care providers.
  • Counsel to Board of nonprofit health care corporation regarding entity structure decision, compliance issues, and regulatory inquiries.
  • Advise multiple clients on structure of transactions to ensure compliance with state and federal health regulations and the corporate practice of medicine doctrine.
  • Complete dismissal of physician from investigation by Texas Medical Board alleging Board violations related to surgical treatment provided.
  • Summary judgment on behalf of hospital corporation and health care facility regarding allegations of direct liability and ostensible agency for actions of physicians.°
  • Defense verdict at trial for surgeon in lawsuit alleging lack of informed consent and negligent performance of surgical procedures.°
  • Defense verdict at trial for physician and health care facility in wrongful death action alleging failure to diagnose patient who died from bacterial endocarditis.°
  • Defense verdict at trial for physician in lawsuit alleging negligent performance of surgical procedure causing avascular necrosis.
