Tiffany A. Blofield concentrates her practice on intellectual property. She was named “Lawyer of the Year,” Trademark Law, Minnesota, 2023 by The Best Lawyers in America. Tiffany is involved in a wide range of intellectual property litigation, including trademarks, copyrights, trade secrets, and patents. She actively works on trademark enforcement, including policing registrations and monitoring for potential infringement. In addition, she advises clients on creative brand protection and trademark clearance. Tiffany helps clients develop strategies in support of their business and legal goals, working to address disputes through negotiation and mediation, or, when necessary, in the courtroom before a jury. She represents clients before federal courts, state courts, appellate courts, and the Trademark Trial and Appeal Board (TTAB).

Tiffany represents companies and professionals as they protect their assets and reputations in complex commercial litigation. Specifically, she handles cases involving contract disputes, Uniform Commercial Code matters, employment matters, products liability, bank litigation, and shareholder disputes. She also works on state and national appeals.

Tiffany is a Qualified Neutral under the Rules of the Minnesota Supreme Court for ADR Rosters and Training, allowing her to conduct mediations pursuant to Rule 114 of the Minnesota Rules of General Practice for the District Courts. As a member of the International Trademark Association (INTA) Directory of Mediators, she mediates matters arising from trademark law.

Experience

  • Trial counsel for Kuryakyn Holdings, Inc., a company that distributes and sells aftermarket products for motorcycles, in a breach of contract case against a former designer of motorcycle lighting products, Just In Time Distribution Company. Just In Time initiated a suit in California alleging RICO violations, fraud, and breach of the parties’ licensing agreement and claiming damages in excess of $3 million. Kuryakyn initiated a separate suit in Wisconsin alleging breach of the parties’ licensing agreement and seeking damages in excess of approximately $2 million. The cases were consolidated in federal court in the Western District of Wisconsin, and the case proceeded to a jury trial to decide the liability claims. The jury awarded a complete verdict on all liability claims in favor of Kuryakyn.°
  • Obtained a reversal of a summary judgment and remand of the case in AMCO Ins. Co. v. Inspired Technologies, 648 F.3d 875 (8th Cir. 2011) relating to a duty to defend insured from a Lanham Act claim.°

  • A. Sween Co., d/b/a Deli Express v. Deli Express of Tenafly, United States District Court for the District of New Jersey, No. 2:13-6337 (KM)(MCA) (judgment entered regarding likelihood of confusion and dilution based on fame; attorney’s fees awarded).°
  • TREAT AND COMPANY LLC v. James Treat, et al., United States District Court for the District of Colorado, No. 13-cv-02464-CMA (trademark litigation resolved through settlement).°
  • Shareholder dispute Donald J. Rachel v. Vaughn Veit, et. al, 05-9895, in Hennepin county State Court, involving a co-owner of multiple companies that lasted for several years before ultimately settling the matter.°
  • Trial team member for Marvin Lumber and Cedar Company in a national case against a wood preservative manufacturer. Following a four-month trial, the jury awarded a $135.8 million verdict in favor of Marvin. The trial verdict was recognized by the National Law Journal in its annual list of Top 100 Verdicts.°
