The EU Foreign Subsidies Regulation – NEW Obligations and Risks for Non-EU Companies

A new EU regulation on foreign subsidies (FSR) has recently entered into force. It allows the European Commission to review financial contributions granted to businesses by non-EU countries, including requests for information, inspections and ordering redressive measures. Beginning October 12, 2023, non-EU companies will have new notification obligations in relation to M&A and public procurement activities.
