Gina Tincher represents clients in a diverse array of industries, including food and beverage, dietary supplement, payments processing, transportation, real estate, and health care. She handles complex commercial contract disputes and an assortment of class actions in state and federal courts across the country.
Gina also assists clients in developing litigation avoidance and risk management strategies tailored to their specific business needs. Gina is well versed in negotiating settlements to help her clients avoid or minimize the impacts of litigation on their businesses. While Gina’s practice focuses on commercial and class action litigation, she also assists clients with regulatory compliance issues.

- Negotiated a class action settlement on behalf of beverage manufacturer against whom plaintiffs asserted claims for false labeling and violations of the Food, Drug, and Cosmetics Act.°
- Negotiated a class action settlement on behalf of safety net health care organization in case challenging third-party liability recovery practices under the federal Medicaid program.°
- Acted as part of team defending insurance company in class action alleging claims related to Illinois’ insurance statutes and regulations governing settlements with insured parties.°
- Acted as part of team that resolved claims against a U.S. wine producer stemming from the termination of a business contract and involving over $50M in claimed damages.°
- Obtained a defense verdict in favor of an insurance company in a case involving claims for bad faith denial of coverage.°
- Negotiated a settlement on behalf of two large multinational payments processing companies in dispute with former vendor in action involving misappropriation of trade secrets claims.°
- Served as second-chair trial counsel in obtaining defense verdict in favor of Colorado municipality in federal jury trial involving claims for unreasonable search and seizure.°
- Served as second-chair counsel, obtained federal jury verdict fully exonerating Colorado municipality accused of First Amendment violations by a former employee.°
- Represented multinational, privately held company in business dispute with former distributors resulting in judgment in favor of client in excess of $9M and dismissal of claims against the client for over $54M in damages.°
- Represented a property owner in federal lawsuit against the United States regarding government munitions and ordnance left on the property following the government’s lease of land during WWII, requiring the United States to pay the client over $30M for cleanup efforts.°
- Prosecuted numerous breach of lease actions throughout the United States.°
- Defended claims brought against property owner related to easements and adverse possession.°
- As co-counsel in a pro bono matter, obtained court order restoring the parental rights of a former female inmate who had successfully completed her sentence as well as a series of rigorous courses while incarcerated in order to overcome her prior substance abuse issues and to become a family health counselor.°
