Kristin Duke is a skilled litigator who represents public and private companies in complex commercial litigation and business disputes. She also has deep experience in financial services litigation, employment matters, and construction litigation. Kristin handles virtually every phase of litigation from pre-litigation negotiations through final disposition or resolution, including jury trials and final arbitration hearings. Her litigation experience extends to state and federal courts.

Prior to joining the firm, Kristin defended clients in matters related to product liability, premises liability, transportation, medical malpractice, catastrophic injury, and nursing homes and long-term care.

  • Obtained a seven-figure settlement for a general contractor in a construction dispute who was wrongfully terminated from a project by the owner.
  • Obtained a dismissal of all claims against a company in a construction dispute who was sued for wrongful termination by the former general contractor on a project.
  • Second chaired at an 8-day final hearing where the firm represented a municipality/project owner against a general contractor in a construction dispute involving claims of project delay and design error.
  • Briefed, argued, and won 12(b)(6) motion to dismiss on behalf of a banking client facing breach of fiduciary duty claims.
  • Obtained a voluntary dismissal of claims in an arbitration brought by a customer against a banking client related to tradeline reporting to the credit reporting bureaus.
  • Defended a school system from Title IX (20 U.S.C. § 1681(a)) claims and claims of violation of Substantive Due Process, violation of Equal Protection, general negligence, gross negligence, negligent hiring, negligent supervision, negligent retention, negligent undertaking, intentional infliction of emotional distress, and punitive damages in connection with an alleged harassment by a teacher of a student.
  • Briefed and won 12(b)(6) motion to dismiss on behalf of two school system employees that were individually named in above-mentioned lawsuit.
  • Obtained a voluntary dismissal for a start-up company being sued by a former founder who brought claims of breach of the stockholder’s agreement.
  • Briefed and secured denial of a motion for summary judgment on behalf of the Trustee in a high-dollar bankruptcy adversary action.
  • Obtained a settlement for a client in a dispute over whether unpaid invoices were for work authorized or requested by the client.
  • Obtained a settlement for a company in a dispute with a former employee involving claims of unpaid commissions.
  • Attended an early mediation and obtained a settlement for the buyer of nursing homes against the former owner in a litigation involving claims of breach of contract and fraud.
  • Briefed and obtained affirmance of summary judgment in a premises liability case involving a slip and fall in a restaurant parking lot.°
  • Briefed and obtained affirmance of summary judgment in a premises liability case on behalf of an apartment complex owner and management company.°
  • Obtained summary judgment in several premises liability cases, involving slip and falls and negligent security.°
  • Obtained a defense verdict on behalf of a retail store in a negligence case involving a deer ladder stand in the Northern District of Georgia, Atlanta Division before Judge Story.°
