MIAMI – July 27, 2023 – A Miami office team of global law firm Greenberg Traurig, P.A. litigators led by Shareholder Jed Dwyer and Associate Emiley Pagrabs obtained a decision in the United States District Court for the Middle District of Florida July 20 dismissing with prejudice all claims against Luli Fama, a Miami swimwear designer, in a lawsuit brought by Alin Pop.
In dismissing the case, Judge Virginia Covington concluded that the plaintiff’s lawsuit, which alleged various claims related to swimwear designer Luli Fama, was completely without factual or legal basis.
The case had originally been filed as a class action by the plaintiff, who claimed he was misled into purchasing a Luli Fama swimsuit by some unidentified social media posts. Judge Covington completely rejected his claims, noting, in part, that the plaintiff had failed to allege any substantive issue with the women’s swimsuit he had purchased. Because any additional attempts by the plaintiff to bring claims against Luli Fama would be futile, the complaint was dismissed with prejudice – meaning that the plaintiff cannot refile his lawsuit.
“We were very pleased to have represented the premiere swimsuit designer Luli Fama in this matter. Luli Fama’s products are without equal and it’s a family business that takes great pride in its work,” said Dwyer and Pagrabs, members of Greenberg Traurig’s Litigation Practice, in a joint statement. “We are glad that Judge Covington’s thoughtful opinion agreed with us that there was no basis for the plaintiff’s unfounded claims.”
“Luli Fama looks forward to focusing on its business and continuing to make high quality swimwear,” Pagrabs noted.
