LOS ANGELES – Nov. 17, 2020 – Global law firm Greenberg Traurig, LLP Shareholders Timothy Long and Lindsay E. Hutner will be speaking at Bridgeport's Independent Contractor & Joint Employment Teleconference, Nov. 20.
Long and Hutner will provide an overview of independent contractor and exemption claims and the use of the ABC Test, as well as discuss independent contractor and joint employment law in California after Prop 22. The program will also examine AB5 and the ongoing debate of how to classify independent contractors and employees, the controversy relating to exempt or non-exempt status of workers and other related issues including liability, damages in these cases, and settlements.
Long has deep experience litigating complex labor and employment issues, having served as lead counsel in multiple class, collective, and representative actions and advising on dozens more. He splits his time between the firm’s Los Angeles and Sacramento offices, and leads the Sacramento office’s Labor & Employment Practice. Long has litigated virtually every wage-and-hour issue there is, including exemption, incentive compensation, independent contractor, off-the-clock, meal and rest, pay practice, and PAGA claims. He also has defeated class and collective certification (including at Stage One) in exemption, off-the-clock, and pay practice cases, and has defeated PAGA claims short of trial. Long has ample experience advising businesses on employment litigation and other types of claims. He litigates employment discrimination and wrongful termination claims, as well as matters involving trade secrets. Long also provides counsel on many corporate matters and often advises entertainment industry employers on emerging issues. He has been invited to speak at and/or chair a number of conferences and programs covering a wide variety of employment law issues.
Hutner focuses her practice on employment law, with an emphasis on litigation matters. She advises employers on all facets of employment relationships, including the design and implementation of employment practices and handbooks, proper employee classification, wage and hour concerns, family and medical leave, workplace investigations, risk assessment of harassment and discrimination claims, terminations, and various employment laws. Hutner represents clients in both federal and state courts, as well as before administrative agencies, defending companies in both class actions and single-plaintiff cases involving employment discrimination, harassment, retaliation, wage and hour, unfair competition, enforcement of non-competes and other restrictive covenants, misappropriation of trade secrets, wrongful termination, and breach of contract.
