Greenberg Traurig’s David C. Fixler to Join Real Estate Bar Association for Massachusetts Webinar Discussing Landmark SJC Decision in Solar Development Case

BOSTON – Sept. 19, 2022 – David C. Fixler, of counsel in the Boston office of global law firm Greenberg Traurig, LLP, will be a panelist on a Real Estate Bar Association for Massachusetts (REBA) webinar Sept. 21 regarding Tracer Lane II Realty, LLC v. City of Waltham, the first Massachusetts appellate case interpreting the scope of the solar protections contained in M.G.L. c. 40A, Section 3, ninth paragraph. Fixler argued this case of first impression on behalf of the victorious solar developer before the Massachusetts Supreme Judicial Court (SJC).

Many large-scale, ground-mounted solar photovoltaic installations are being proposed to meet alternative energy needs in the face of a warming climate. With these projects come legal issues and challenges from abutters and municipalities alike, including debates about the scope of zoning protections available to these projects under M.G.L. c. 40A, Section 3. Hosted by REBA’s Land Use & Zoning and Environmental Law Sections, the panel will discuss Tracer Lane and the decision’s broader implications for commercial solar development in Massachusetts.
