James L. Ryerson focuses his practice on intellectual property and complex commercial litigation. He has litigated patent, trademark, and copyright cases in federal courts around the country, and been involved in post-grant patent proceedings before the Patent Trial and Appeal Board and trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board. In addition to his litigation experience, Jamie has experience conducting due diligence for intellectual property transactions, counseling startups on intellectual property issues, and prosecuting patent applications. A registered patent attorney, Jamie's experience has involved a wide array of industries and technologies, including electronics, pharmaceuticals, medical devices, manufacturing, computer technology, toys, search engines, automotive technology, and eCommerce.

Experience

  • Represented manufacturer of music speakers and retailer in multi-defendant patent infringement case in the Southern District of Florida. Successfully requested an early claim construction hearing, and, after a favorable claim construction ruling, the plaintiff stipulated to non-infringement.
  • Represented laptop computer manufacturer in patent infringement litigation in the District of Delaware. The case settled following a ruling precluding the plaintiff’s technical advisor from accessing our client’s highly-confidential information.
  • Member of team that obtained a $30 million past damages award for patent infringement following a two-week jury trial in the Eastern District of Virginia.°
  • Member of trial team that obtained a judgment of non-infringement (affirmed on appeal) following a jury trial in the District of Delaware. The patents at issue concerned robotic pharmacy automation system.°
  • Represented manufacturer of laminate flooring in patent infringement litigation in the Northern District of Georgia. Obtained stay of litigation pending inter partes reexamination, and the case settled thereafter.°
  • Representation of ANDA filer in Paragraph IV challenge in the District of New Jersey relating to Xartemis® extended-release tablets for the treatment of acute pain requiring opioid treatment and for which alternative treatment options are inadequate.
  • Represented petitioner in inter partes review proceeding involving placental tissue grafts; received final written decision finding all challenged claims unpatentable.
  • Represented patent owner in inter partes review proceedings involving patents related to cross-platform electronic messaging.
  • Represented patent owner in an inter partes reexamination involving patent relating to thermal processing of flexographic printing plates.°
