Adrian Nuñez is a member of the Litigation Practice in Greenberg Traurig’s Miami office with over 12 years of experience. He focuses his practice on assisting clients to find cost-effective approaches to complex commercial matters. His practice includes domestic and international arbitration and litigation with a focus on commercial disputes, and he has handled matters conducted in Spanish. Adrian has wide-ranging experience handling virtually all states of litigation including trials and appeals, and works closely with foreign and local counsel, experts, and witnesses to prepare cases. He has represented investors and financial institutions in federal and state courts, as well as in bankruptcy, regarding contract disputes and matters related to fraudulent transfers, enforcement of mortgages, guaranties, and security agreements. He also has handled complex corporate disputes in litigation with experience in partnership and joint venture disputes, business torts, unfair trade practices, and trade secrets.

Adrian represents companies in arbitration before the International Centre for Dispute Resolution (ICDR) of the American Arbitration Association (AAA), the International Court of Arbitration of the International Chamber of Commerce (ICC), and American Health Law Association (AHLA).

Experience

  • Represented U.S. airline in matters of first impression under Title III of the Helms-Burton Act; obtained dismissal of claim for trafficking in beach-front property confiscated by the Cuban Government.°
  • Represented Colombian investors in successful enforcement of ICC arbitration award, overcoming objections to recognition under the New York Convention, garnishing assets pre-judgment and obtaining monetary recovery.°
  • Represented multi-national financial institution in FINRA arbitration defending claims of negligent supervision, breach of contract and breach of fiduciary duty culminating in a settlement.°
  • Represented major beverage distributor in ICDR arbitration regarding terminated distributorship in Costa Rica, defending claims seeking extra-contractual compensation and negotiating settlement of matter.°
  • Represented minority partner of Puerto Rico dialysis business in joint venture dispute in both federal court and before the AHLA in commercial arbitration.°
  • Represented U.S. construction company in investor-state arbitration in enforcement of protections under U.S.-Panama bilateral investment treaty and free trade agreement to recover substantial expropriated investments in various public construction projects.°
  • Represented Mexican governmental agency in cross-border disputes defending against subpoenas for document discovery and depositions in aid of Mexican litigation over failed bid pursuant to 28 U.S.C. § 1782.°
  • Represented Russian bank in petitioning for discovery in aid of bankruptcy proceeding in Russia pursuant to 28 U.S.C. § 1782.°
  • Represented multinational Fortune 500 medical equipment manufacturer and Brazilian affiliate before ICDR in recovery against Brazilian distributor.°
  • Represented multi-national private water concessionaire before the ICC in public utility tariff dispute with the City of Guayaquil, Ecuador.°
  • Represented international logistics service provider defending claims including misappropriation of trade secrets, tortious interference of business relationships and unfair competition involving operations in the United States and Argentina.°
  • Represented foreign government in forfeiture ancillary proceeding in federal court recovering restitution ordered in underlying criminal proceeding.°
  • Obtained reversal by the Third District Court of Appeal of Florida of a denial of pre-judgment attachment and garnishment of real property and monies sought in fraudulent transfer action. General Electric Co. v. Chuly International, LLC, 118 So. 3d 325 (Fla. 3d DCA 2013).°
