Adil M. Khan, a shareholder in Greenberg Traurig’s Los Angeles office, is a commercial litigator with a diverse practice focused on commercial disputes and class actions. He focuses on complex litigation in several fields, including false advertising, unfair competition, products liability, and construction. Adil’s clients operate across a variety of industries, including food service, e-commerce, retail, dietary supplement, financial services, homebuilding, and manufacturing. He has deep experience in all phases of civil litigation, from the pleadings stage through trial, in both state and federal courts.

Adil has wide-ranging experience with consumer class actions alleging claims under California’s Unfair Competition Law, False Advertising Law, and Consumer Legal Remedies Act, as well as federal statutes like the Telephone Consumer Protection Act. Adil has helped his clients navigate commercial real estate disputes, contract and negligence claims, and lender liability issues, and he has helped financial institutions in customer- and broker-initiated lawsuits and arbitration proceedings. He has also defended major product manufacturers and medical device companies in product liability and personal injury claims, and he has represented companies in a variety of other contexts, including pursuing former executives and managers for theft of trade secret, unfair competition, conversion, and fraud.

He has also helped clients defend against labor & employment claims, including wage-and hour-class actions under federal and state law, as well as individual and multi-plaintiff claims involving discrimination, harassment, and retaliation.

Adil is the co-host of the Unfair Competition Defense Podcast, which analyzes hot-button topics and defense strategies relating to state and federal unfair competition and consumer protection statutes.

  • Representation of a major financial institution in jury trial with the plaintiff seeking $88 million for an alleged breach of fiduciary duty and aiding and abetting various wrongful conduct by third parties. Jury found no liability after multi-week trial.
  • Obtained summary judgment for commercial lender in lawsuit alleging fraudulent lending scheme, and successfully defended summary judgment ruling on appeal.
  • Representation of a commercial landlord in a dispute with the anchor tenant seeking damages and lost profits exceeding $5 million.
  • Represented securities brokerage company in FINRA arbitration claim alleging multiple causes of action including breach of fiduciary duty.
  • Representation of modular fabrication company in dispute with property developer.
  • Secured voluntary dismissal of product defect claims against furniture manufacturer.
  • Representation of credit card processing company in various disputes with former executives and employees based on claims of breach of fiduciary duty, fraud, theft, and misappropriation of trade secrets.
  • Settled a putative class action alleging false advertising about the country of origin and quality of high-end haircutting shears on behalf of Hattori Hanzo Shears, Inc. After seeing GT’s motions for summary adjudication and to preclude class certification, class member declarations, and Adil’s tough deposition of plaintiff’s expert, plaintiff’s lead counsel reached out for an individual settlement.
  • Defended national food chain against false advertising claims alleging “hidden” and misleading fees for online orders.
  • Settled a putative class action alleging false advertising and breach of warranty claims against manufacturer of nutritional supplements. Secured settlement on individual basis.
  • Settled of TCPA claims against group of automobile dealerships based on allegations that putative class members received unsolicited prerecorded marketing messages.
  • Representation of publicly traded owner of trade schools in class actions involving claims of fraudulent representations.
  • Defended Tropicana Products Co., Inc., Welch Foods, Inc. and Ocean Spray Cranberries, Inc. in three separate jury trials involving claims of false advertising in violation of the Lanham Act. All three cases resulted in defense judgments.
  • Defense of former manufacturers of asbestos-containing products in several cases alleging claims of personal injury and product liability.
  • Representation of the major medical device company in litigation alleging product defect.
  • Representation of the nation's largest independent company that offers title insurance, property valuations and closing services in a wage-and-hour class action involving misclassification and reimbursement claims.
  • Representation of a Fortune 50 company in a federal wage-and-hour class action trial.
  • Representation of one of the largest clinical laboratory networks in the world in a variety of class action and single-plaintiff cases. Settled class action brought on behalf of thousands of current and former employees after court tentatively ruled against certifying a class on the merits of the claims. Settled multiple single-plaintiff cases alleging wide variety of claims under California Labor Code.
  • Representation of the world's largest independent airline catering, hospitality, and logistics company in a variety of lawsuits involving allegations of harassment and discrimination. Resolved multiple single-plaintiff actions alleging an array of claims, including non-compliant wage statements, religious discrimination, and sexual harassment.
