Phoenix Litigation Practice chair Andy Halaby has been counseling clients in law of lawyering, intellectual property, and other business-related matters for nearly 30 years.
Business and Regulation of the Practice of Law
Andy has extensive experience advising clients in the practice-of-law space. He has advised lawyers and law firms, law-adjacent businesses, investors, and others on law practice-related transactions and opportunities, including but not limited to capital investment and acquisition transactions. He has deep experience advising clients on Arizona’s Alternative Business Structure (ABS) law, including counseling multiple applicants through the ABS licensing process.
Andy also advises clients including inside counsel, outside counsel and law firms on professional responsibility and related matters, including discipline defense, lawyer disqualification, fee disputes, and lawyer liability matters. He draws on more than a decade’s experience as Ethics Chair of a national law firm headquartered in Phoenix, as well as richly varied public service in connection with the law of lawyering and its administration. This service has included
- participating, under the auspices of the Arizona Supreme Court Committee on Alternative Business Structures, in multiple working groups exploring potential improvements to Arizona’s ABS law;
- serving on the Arizona Supreme Court’s Task Force on Lawyer Ethics, Professionalism, and UPL; Independent Bar Counsel panel; and Judicial Performance Review Task Force;
- chairing the State Bar of Arizona’s Conflict Case Committee, and serving as a member of its Committee on Professional Responsibility and now its Ethics Advisory Group, where he fields ethics hotline calls from lawyers across the state; and
- teaching multiple semesters of Professional Responsibility at the Sandra Day O’Connor College of Law at Arizona State University.
Intellectual Property and Technology
A former professional engineer, Andy has served as lead counsel in dozens of IP matters, including patent infringement, trade secret misappropriation, trademark infringement, trade dress infringement, unfair competition, cyberpiracy, copyright infringement, and deceptive advertising cases, as well as disputes involving, among other things, computer fraud and abuse, data security, data integration, search engine optimization, software development, software licensing, software conversion, and life sciences. A registered patent attorney, he represents both plaintiffs and defendants, in matters ranging from six to nine figures of liability exposure, involving a wide range of products and services.
Business Litigation
Andy also enjoys counseling clients in brewing, and ripened, business disputes. His litigation experience includes breach of contract, business tort, “business divorce,” antitrust, derivative action, class action, securities, lender liability, ERISA, False Claims Act, corporate governance, commercial real estate, trust and estate, corporate defalcation, defamation, insurance coverage, life insurance and annuity, and other complex disputes. He is experienced in virtually all phases of the civil litigation process, from preliminary relief proceedings, through first chairing jury trials and arbitration hearings, to post-trial/hearing enforcement proceedings and appeal.
Andy is a recognized thought leader, whose work has been cited in, among other things, treatises on intellectual property law, remedies, evidence, professional responsibility, and the First Amendment.
