Brian T. Feeney has more than 25 years of experience representing major financial institutions, Internet companies, pharmaceutical companies, major retailers, and other corporate clients in a wide variety of commercial and business disputes, particularly in claims arising under unfair trade practices and antitrust laws, consumer privacy statutes, consumer fraud disputes, real estate disputes, and contract disputes. He has litigated and won multiple arbitrability disputes concerning the Federal Arbitration Act and various state arbitration acts at both the trial and appellate court levels. Brian also represents clients in commercial real estate disputes with borrowers and guarantors, securing victories on behalf of his clients in both trial and appellate courts.

  • Won dismissal on behalf of a major medical device company facing fraud claims related to a settlement agreement regarding prior patent litigation.
  • Won dismissal in a complex matter involving antitrust and related tort claims on behalf of a major telecommunications company, preserving substantial business relationship for the client.
  • Following adverse summary judgment ruling in a multimillion-dollar contract claim, persuaded appellate court to accept the case for an interlocutory appeal, following which the appellate court reversed and directed the trial court to enter summary judgment in favor of nationwide retailer.
  • Won summary judgment on behalf of a medical software company facing allegations of tortious interference and breach of contract – a matter affirmed on appeal by U.S. Circuit Court of Appeals.
  • Won summary judgment on behalf of a major financial company on customer claims for breach of contract, fraud, violation of the unfair trade practices act, and related claims.
  • Won dismissal and affirmance on appeal on behalf of a major financial company in a Federal Arbitration Act matter, part of a circuit split later resolved by the Supreme Court of the United States in favor of the client’s position.
  • Won summary judgment and dismissal rulings on behalf of a major Internet company and nationwide restaurant chain in putative nationwide class actions brought by consumers under the Telephone Consumer Protection Act, preventing considerable statutory damages.
  • Secured reversal at the appellate court level of a trial court order vacating an arbitration award on behalf of a securities broker-dealer.
  • Tried a breach of contract case involving successor liability issues in arbitration, securing a judgment on behalf of manufacturer.
  • Won an order compelling arbitration on behalf of a national education company in putative class action alleging fraud and violations of unfair trade practices act.
  • Co-tried complex contract dispute on behalf of major financial client, resulting in settlement during the trial.
  • Secured judgment in hotly contested commercial foreclosure and guarantor liability actions on behalf of lender, and successfully defended the judgment before appellate court.
  • Co-led representation of successful exoneration and freedom for a Philadelphia man wrongfully convicted and sentenced on charges of triple homicide who had spent 28 years in prison.
