Jaclyn DeMais focuses her practice on complex commercial litigation matters, representing clients from a variety of industries including retail, consumer products, pharmaceutical, technology, and hospitality. She has experience defending class actions and mass tort proceedings involving claims arising under various state consumer protection laws and has handled business litigation and arbitration involving claims for breach of contract, breach of fiduciary duty, and fraud.

Jaclyn has also represented clients in white collar criminal matters, including SEC and DOJ investigations.

  • Defending pharmaceutical company in an action alleging fraud regarding manufacturing and compliance capabilities.
  • Defended Fortune 50 client against allegations of benzene contamination in consumer products in putative class action.
  • Defended a haircare product distributor against mislabeling and false advertising claims in a putative nationwide class action. Secured the involuntary dismissal of all but New York state law claims on the pleadings and secured a voluntary dismissal of the rest.
  • Defended a haircare company against allegations that client’s products caused hair loss in over a dozen putative class action lawsuits filed across the country involving claims of mislabeling and false advertising, which were consolidated in the Southern District of New York.
  • Defeated class certification in a putative nationwide class action against a seller of luxury timeshare products and its affiliates alleging fraud, breaches of fiduciary duty, and civil RICO violations by purchasers of interests in a resort in St. Thomas, U.S. Virgin Islands. Defended the denial of class certification by defeating plaintiffs’ petition for leave to appeal in the Third Circuit.
  • Defended electronics company against claims of fraud, consumer protection violations, and breaches of warranty in a putative class action on behalf of a nationwide class and several state subclasses. Obtained voluntary dismissal of claims.
  • Defended a retail furniture company in a class action alleging TCPA violations, securing voluntary dismissal of the claims.
  • Secured dismissal of claims against major telecommunications provider for tortious interference and trademark infringement under state and federal law.
  • Represented witness in high-profile federal criminal trial alleging conspiracy and fraud against state public officials.
  • Argued appeal for a pro bono client before the Superior Court of New Jersey, Appellate Division.
