AI's Double-Edged Role in Dispute Resolution: When the Machine Tries to Solve the Dispute it Created

Greenberg Traurig Shareholder David S. Bloch will be a speaker at JAM's "AI's Double-Edged Role in Dispute Resolution: When the Machine Tries to Solve the Dispute it Created" event on Wednesday, December 11. This event will have a live mock mediation simulation featuring an international dispute, where the mediator will have to navigate cross-border regulations involving the European Union, US, and China—covering the EU AI Act, Chinese data sovereignty, and US technology standards—as well as decode the different cultures of the litigants, each bringing their own approaches and expectations to the table. They will explore how a highly experienced human mediator manages these challenges in real time and see how different AI platforms might predict outcomes and advise on next steps. Can AI—both the creator of the problem and the proposed solution—outperform the human mediator? At the end of the simulation, participants—all seasoned international lawyers and ADR professionals—will explore the unique complexities of a similar case being taken to arbitration if neither AI nor a human can resolve it.
