Adam Kirschbaum is an associate in the Litigation Practice in Greenberg Traurig's New York office. Adam focuses his practice on general commercial litigation, with experience in both state and federal courts. Adam has experience in virtually all phases of litigation, including drafting briefs and motions, conducting fact and expert discovery, and assisting in various stages of trial preparation. Adam has also represented clients in high-profile environmental, real estate, antitrust, and contract disputes. He also regularly litigates matters under Article 81 of New York’s Mental Hygiene Law.

  • Representation of Empire State Development in a New York State Supreme Court matter which resulted in dismissal of two separate challenges to the state government approvals of a new arena for the NHL’s New York Islanders hockey team. The challenges to the Belmont Redevelopment Project were brought by a neighboring village and a group of citizens seeking to stop the ongoing construction of the arena alleging, among other grounds, that the project approvals violated the New York State Environmental Quality Review Act (SEQRA) and the public trust doctrine.
  • Representation of Long Island Rail Road Company and the Metropolitan Transportation Authority in a New York State Supreme Court matter which resulted in dismissal of the challenges of the Village of Garden City brought under the New York State Environmental Quality Review Act (SEQRA) and Public Authorities Law to the installation of utilities poles.
  • Representation of large energy company in New York State Supreme Court in litigation under the Climate Leadership and Community Protection Act (“CLCPA”) regarding a permit modification to construct and operate a natural gas fired power plant.
  • Representation of client, against the United States government, for alleged violations of the Clean Air Act for manufacturing and selling an alleged “defeat device”.
  • Representation of citizen coalition for litigation in New York State Supreme Court under SEQRA and other provisions for the purpose of preventing the closure of a local New York airport.
  • Repeated representation of large hospital client in New York State Supreme Court under Articles 9, 33, and 81 of New York’s Mental Hygiene Law.
  • Representation of international pharmaceutical company in federal court, defending against antitrust and other claims.
  • Representation of international pharmaceutical company in federal court against claims under the False Claims Act and Anti-Kickback Statute.
  • Representation of a Fortune 100 bank in federal court against breach of contract and other claims related to a real estate transaction.
  • Representation of plaintiff in both state and federal court for damages related to counterparty’s breach of a loan agreement, security agreement, and guarantee.
