ABA's 47th Annual Forum on Franchising

Denver shareholder David Zetoony is a panelist on the "Privacy, Please: Practical Tips for Navigating Data Privacy Laws" session on October 16, from 11:00 to 4:30 p.m. MT. 

With no national data privacy law in place in the United States, several states have enacted privacy laws affecting franchise systems. In addition, franchisors doing business outside the United States must understand and comply with international privacy laws and regulations, such as the European Union General Data Protection Regulation. This program will help franchisors and franchisees to understand the legal landscape and their obligations to protect the personal data collected in franchise systems, including:

  • collection, storage and usage of data;
  • development of programs and privacy policies as required and to mitigate risk;
  • management of data flow between various sources, including related companies and third parties such as vendors, franchisees, and customers; and
  • allocation of data privacy responsibilities between franchisor and franchisee.

The panelists will discuss consequences of violations of data privacy laws, policies and contractual provisions franchisors and franchisees should implement related to data breaches and other data security incidents, and management of data subject access requests. Intensive materials will include an appendix of selected domestic and international data privacy regulations by jurisdiction.
