Mark A.   • Member of the Defense Steering Committee in In Re Chinese Manufactured Drywall Product Liability Litigation, MDL No. 2047, and represented multiple homebuilders in both state and federal court individual and class action lawsuits involving allegedly defective Chinese manufactured drywall.
  • Represented U.K.-based digital payment company in defense of a $75 million dollar putative class action; won dismissal for lack of personal jurisdiction.
  • Represented Chinese printed circuit board manufacturer in case asserting competing claims to ownership over a federally registered trademark; won summary judgment with client obtaining ownership over trademark and cancellation of adversary’s registered trademark.
  • Represented Chinese printed circuit board manufacturer in a two-week breach of contract trial with one of its U.S.-based distributors, precluding the distributor from recovering more than 99% of the damages sought and resulting in being named 2019’s most effective international litigators by the Daily Business Review.
  • Represented multiple online retailers in defense of novel claims alleging their use of session replay technology on their websites constituted illegal wiretapping under the FSCA; won first dismissal (and others) of these novel claims in Florida.
  • Represented Sandals Resorts International Ltd. in defense of a nationwide consumer fraud class action based on alleged violations of FDUTPA and unjust enrichment; won case on a motion to dismiss based on forum non conveniens grounds.
  • Represented Loews Hotels in defense of a nationwide consumer fraud class action based on alleged violations of FDUTPA; case settled on an individual basis after obtaining dismissal of nearly all claims on a motion to dismiss.
  • Represented 1 Hotel South Beach in defense of a nationwide consumer fraud class action based on alleged violations of FDUTPA; won case on a motion to dismiss.
  • Represented plumbing product distributor in defense of nationwide class action lawsuit involving, among others, claims of breach of express warranty, breach of implied warranty of merchantability, breach of state consumer protection laws, and unjust enrichment; negotiated nationwide class settlement.
  • Represented multiple companies in defense of class actions under the TCPA, FTSA, and FSCA.
  • Represented Allscripts Healthcare Solutions, Inc. in defense of a Florida class action involving allegedly defective electronic health care records software program; reached satisfactory nationwide class settlement.
  • Represented Hilton Hotels Corporation in defense of a five-week arbitration involving claims of mismanagement and breach of contract in which plaintiff sought in excess of $100 million; arbitration award in favor of defense plus partial recovery of defense attorneys’ fees.
  • Represented Microsoft Corporation in defense of a Florida class action brought under FDUTPA; main action resulted in class settlement and attorneys’ fees issues resolved after four-day evidentiary hearing.
  • Represented recording artist in preventing the publication of an unauthorized biography; obtained preliminary injunction against author and case thereafter settled.
  • Represented Interval International in an eight-day evidentiary hearing against a former executive accused of violating a non-compete agreement; obtained preliminary injunction and case thereafter settled.
  • Represented prominent Ecuadorian bankers accused of bank fraud and civil RICO violations; obtained forum non conveniens dismissal of claims.
  • Represented Hilton Hotels Corporation and Hilton International Co. in negligent security and wrongful death cases arising out of 2004 terrorist attack at an Egyptian hotel; obtained forum non conveniens dismissal of claims.
  • Represented insurance company in case brought by excess carrier alleging bad faith failure to settle within the primary policy’s limits; obtained final summary judgment on the eve of trial and a substantial attorneys’ fee award in favor of client.
