Greenberg Traurig is experienced in Tribal Gaming and gaming regulation. We represent Indian Tribes and Nations in the negotiations of tribal-state gaming compacts, provide legal advice to tribal gaming boards, and serve as independent legal counsel to tribal gaming regulatory authorities. Our attorneys understand that tribal gaming enterprises provide a critical source of revenue for tribal governments, represent an important generator of economic development for tribal communities, and offer essential employment and career opportunities for tribal members. We also recognize that the integrity of gaming and its continued success in Indian Country is predicated on maintaining a balance between the needs of the gaming enterprise and the capacity of tribal regulators to protect tribal assets and ensure compliance with the Indian Gaming Regulatory Act (IGRA) and the terms of tribal-state gaming compacts.
Our attorneys assist tribes in evaluating proposals for the development and construction of a gaming facility, terms for financing, and the purchase of equipment and supplies. We also have experience evaluating and negotiating proposed management agreements for our tribal clients. We have experience addressing clients’ needs before the National Indian Gaming Commission (NIGC) including handling potential enforcement actions, approval of management agreements, and tribal rights to engage in gaming activities on after-acquired lands pursuant to the IGRA framework.
We are also active with respect to federal regulatory developments that affect tribal gaming, particularly those of the NIGC. We advise tribes and tribal gaming commissions in their efforts to ensure that the NIGC regulations are consistent with tribal interests.
Tribal Sports Betting
We also assist tribes and tribal gaming agencies with analyzing and establishing tribal online sports betting operations pursuant to the IGRA and respective tribal-state gaming compacts. This includes drafting tribal online sports betting legal opinions and reviewing services contracts and consulting agreements in the tribal online sports betting space. Our team also has experience assisting with the review and drafting of tribal sports betting codes and regulations.
We are also active with respect to federal regulatory developments that affect tribal gaming, particularly those of the NIGC. We advise tribes and tribal gaming commissions in their efforts to ensure that the NIGC regulations are consistent with tribal interests.
