Lindsay E. Hutner is Co-Chair of the firm’s Labor & Employment Practice’s Employment Litigation & Trials Group. Facing high stakes and strong opposition, Lindsay is a focused, practical, and dedicated litigator whose clients trust her to not only vehemently defend their interests, but offer pragmatic, no-nonsense advice, all with an eye toward their business needs. An experienced employment litigator, Lindsay has spent nearly twenty years defending businesses across California in complex workplace disputes. From high-stakes class actions to sensitive harassment claims, Lindsay blends legal acumen with a strategic, earnest approach to protect her clients’ interests.
Lindsay strives to anticipate risks, defuse conflicts, and craft innovative dispute strategies for her clients. Whether in trial, arbitration, or negotiations, she brings a commanding presence, sense of humor, and an unwavering commitment to each case.
Beyond the courtroom, Lindsay is a speaker and advisor on a wide variety of employment law issues and is the co-chair of PLI’s annual conference, Cutting-Edge Employment Law Issues. Lindsay also writes frequently and is the co-editor of PLI’s California Employment Law treatise, and a contributing editor of PLI’s Employment Law Yearbook; both treatises are updated annually and focus on employment law issues for employment law practitioners.
As Chair of the San Francisco office’s Women’s Initiative, Lindsay is proud to serve as a mentor to rising attorneys and is a fierce advocate for diversity in the legal profession.

Experience
- Obtained summary judgment in favor of client, one of the nation’s largest real estate management companies, on all claims in wrongful termination, disability discrimination, and wage and hour action brought by former maintenance employee.
- Defended large cruises and events company on 22 of 24 causes of action asserted by a former employee in arbitration. The arbitrator declined to award the claimant any recovery against the individual respondents and only granted $4,500 on the remaining two causes of action.
- Obtained dismissal of a wage and hour class action complaint, with prejudice, in California Superior Court.
- Obtained full summary judgment on race discrimination and harassment matter in California Superior Court.
- Obtained full summary judgment on disability discrimination and retaliation case in Nevada state court.
- Obtained full dismissal of contract action based on forum selection clause, in California Superior Court.
- Obtained ruling from California Labor Commissioner denying wage and hour claims brought by three employees following evidentiary hearing.
